What the decision says
RECO found that Alex used and facilitated an unregistered individual, called “Individual B” in the decision, to provide representation, services and advice to her clients. Only registered people may trade in real estate in Ontario. Alex both used that person and assisted their trading.
She also failed to deal directly with one client about a trade, and failed to properly represent and advise that client, including failing to confirm matters and review documents such as signatures and initials.
The decision records that she falsely witnessed the execution of a document by her client. Taken together, the committee found the conduct disgraceful, dishonourable, unprofessional or unbecoming under section 39.
The same pattern was found in her dealings with two buyer clients, called “Buyer A” and “Buyer B”.

Why this record matters
At $60,000 this is the largest fine in the records published here. Two things drove it: an unregistered person was put in front of clients who believed they were dealing with a registrant, and a signature was witnessed that the witness did not see.
