Who is Mustafa Zia?

Mustafa Zia, registered as Mohammed Mustafa Zia, is a real-estate registrant in Mississauga, Ontario, whose public listings describe him as a RE/MAX-affiliated broker. In February 2022 RECO’s Discipline Committee found he had breached six sections of the Code of Ethics during a 2017 transaction and fined him $20,000.

What did RECO find Mustafa Zia did?

On agreed facts: he put sellers into a five-month exclusive listing without properly explaining it, presented two offers from a corporation he controlled without clearly disclosing his interest, and failed to obtain consent before his brokerage represented both sides. The sale was cancelled by mutual release after the sellers’ lawyer discovered the connection.

Was Mustafa Zia found guilty of fraud?

No. The decision is a professional-conduct finding under the REBBA 2002 Code of Ethics. One of the sections breached is headed “Error, misrepresentation, fraud, etc.”, but the finding under it is a failure to use best efforts to prevent misrepresentation or unethical practice. There is no criminal or civil fraud finding.

How much was Mustafa Zia fined?

$20,000, payable to RECO by 30 June 2022. He was also ordered to complete RECO’s MCE Compliance and Ethics in Real Estate course, Parts 1 and 2, by 15 May 2022.

Is Mustafa Zia still licensed in Ontario?

The decision did not suspend or revoke his registration, and his public listings continue to present him as an active broker. Registration status can change, so check RECO’s registrant search for the current entry before relying on this.

Can I still hire Mustafa Zia?

Yes, if he is registered. A discipline record is public so that you can make that decision with full information. If you do, ask directly whether he or any company he controls has an interest in any buyer, and insist on written multiple-representation disclosure before any offer.
