- Do you, or any company or relative of yours, have any interest in any buyer you might bring me? See when your agent is the buyer.
- If a buyer comes through your brokerage, who represents me, and what will you stop doing for me? See multiple representation.
- How long is this agreement exclusive, and what is the holdover? See exclusive listings.
- How did you arrive at this price? Show me the comparables.
- What is your commission, and is it owed if I find the buyer?
- Can I take this home and have my lawyer read it before I sign? If the answer is anything but yes, stop.
- Will you put every one of these answers in writing?
Why writing matters.
In the Zia case the sellers had signed forms, but the forms did not tell them what they needed to know, and nothing else was in writing. Written answers to plain questions are what a regulator, or a lawyer, can act on later.
